Let’s look at an apartment building example where the building’s plumbing and drainage systems need updating. The issue is affecting some of the apartments, but not the common areas. Sometimes, the body corporate takes care of this update, but if they lack the funds or motivation and some apartments are more affected by the issues, the owners of these apartments may fund it instead. However if the issue affects the common areas as well, the responsibility falls more clearly to the Body Corporate. To create a bit more clarity, the general rule is, if the problem is within the borders of the owned property, or an apartment in this example, the apartment owner is responsible. Blocked sink or shower drains: This depends where the blockage is. For the shower, the drainage system sits under the floor, and is therefore out of the apartment borders - in this scenario, the body corporate should cover the costs. However the sink drainage is partially in the apartment, extending out of it. If the blockage is right under the sink in the trap, it falls on the lot owner to deal with the issue.

Ruptured or leaking pipes: For any inside walls or floors piping issues, it is the location that usually decides who is responsible. If the issue is in the internal walls of the apartment, the lot owner needs to take care of it. If it is located in boundary walls, or walls between different apartments, the body corporate should cover the costs.
Mould or damp spots: Exactly the same logic applies here, the responsibility depends on which wall the issue lies, either internal apartment wall, or an external or shared wall. |
